1. GENERAL INFORMATION
- The foreign judicial decision of divorce resulting from marriage between Brazilian citizens or between a Brazilian citizen and a foreigner must be confirmed in Brazil by the Brazilian Superior Court of Justice ("Superior Tribunal de Justiça"), even if the marriage certificate has never been issued in Brazil. Only after the divorce confimation a new marriage certificate can be issued. In order to obtain the confirmation ("homologação"), the interested party will forward to Brazil, to submit the request to the Brazilian Superior Court of Justice, after hiring the services of a lawyer in Brazil
a) the power of attorney for the lawyer;
b) the foreign judicial divorce decision, legalized by the Consulate;
c) the original marriage certificate, legalized by the Consulate; and
d) if possible, a statement of agreement, signed by the former spouse, whose signature must be recognized by a public notary.
- Foreign documents, if not written in the Portuguese language, will have to be translated by an official translator in Brazil.
